Gadamer's book extends and codifies the main hermeneutical concepts of Bultmann, Heidegger, and their adherents, and can be considered a summa of what Robinson calls "The New Hermeneutic." By Robinson and other theologians, and by Continental literary critics, Wahrheit und Methode has been welcomed as a philosophical justification for "vital and relevant" interpretations that are unencumbered by a concern for the author's original intention. On this point "The New Hermeneutic" reveals its affinities with "The New Criticism" and the newer "Myth (...) Criticism." All three have impugned the author's prerogative to be the determiner of textual meaning. Gadamer, however, grounds his anti-intentionalism only partially in aesthetics and not at all in the collective unconscious but primarily in the radical historicism of Martin Heidegger. (shrink)

In _Why Knowledge Matters_, influential scholar E. D. Hirsch, Jr., addresses critical issues in contemporary education reform and shows how cherished truisms about education and child development have led to unintended and negative consequences. Hirsch, author of _The Knowledge Deficit_, draws on recent findings in neuroscience and data from France to provide new evidence for the argument that a carefully planned, knowledge-based elementary curriculum is essential to providing the foundations for children’s life success and ensuring equal opportunity for (...) students of all backgrounds. In the absence of a clear, common curriculum, Hirsch contends that tests are reduced to measuring skills rather than content, and that students from disadvantaged backgrounds cannot develop the knowledge base to support high achievement. Hirsch advocates for updated policies based on a set of ideas that are consistent with current cognitive science, developmental psychology, and social science. The book focuses on six persistent problems of recent US education: the over-testing of students; the scapegoating of teachers; the fadeout of preschool gains; the narrowing of the curriculum; the continued achievement gap between demographic groups; and the reliance on standards that are not linked to a rigorous curriculum. Some people have found my distinction between meaning and significance useful. In the following revision of that distinction, I hope to improve its accuracy and perhaps, therefore, its utility as well. My impulse for making the revision has been my realization, very gradually achieved, that meaning is not simply an affair of consciousness and unconsciousness. In 1967, in Validity in Interpretation, I roundly asserted that “there is no magic land of meanings outside human consciousness.” 1 That assertion would be true (...) if, godlike, we could oversee the whole of human consciousness, past, present, and future. But we language users, being limited creatures, intend our verbal meanings to go beyond what we can pay attention to at any moment. We intend our meanings to transcend our momentary limitations of attention and knowledge. Hence there is a land of meanings beyond past and present human consciousness—the land of the future. What I should have said originally is that there is no magic lance of meanings beyond the whole extent of human consciousness, past, present, and future. This correction of my original statements leads to a deepening of the concept of meaning.In 1960 I first proposed the analytical distinction between two aspects of textual interpretation. One of them, meaning, was fixed and immutable; the other, significance, was open to change.2 I acknowledged that significance, changeable or not, is the more valuable object of interpretation, because it typically embraces the present use of texts, and present use is present value. But I argued that, in academic criticism, the significance and use of a text ought to be rooted in its fixed meaning, since otherwise criticism would lack a stable object of inquiry and would merely float on tides of preference. The claim that one reader’s opinion is as valid as another’s would then be right, despite any indignant protest to the contrary. I did not wish to dissuade people from floating on the tides of preference if that was what they wished to do. I intended to provide a firm justification for those who wished to pursue historical scholarship. 3 I also assumed that even those who did not pursue historical scholarship might sometimes wish to exploit the possibility of historically fixed meaning. Among philosophers as well as linguists the battle is still joined between those who view the correlation between meaning and linguistic form as strictly determined by convention and those who argue for the essential indeterminacy of the relationship between meaning and form.1 Plato's Cratylus aside, the philosphical dialogue that forms the locus classicus of this debate is the following: "You're holding it upside down!" Professors Battersby and Phelan have presented a lively challenge. They urge readers to reject the later, fuzzy Hirsch, in favor of an earlier, truer Hirsch.Their first objection is that Hirsch 2 has mistaken the nature of literary meaning. Battersby and Phelan reject the view that a literary work carries a general meaning analogous to the concept of “bicycle” that can be exemplified by all bicycles. They propose that a literary work is “more appropriately conceived as … a (...) Schwinn or even a red Schwinn three-speed with a blue seat and two flat tires”. They object to my adoption of Sir Philip Sidney’s claim that literature provides both the general concept and the particular example simultaneously. By saying that literature does both things at once I conflate and confuse, they say, two different intentions, because, as they aver, an exemplified concept cannot be further exemplified”.This claim reinstates the familiar New Critical doctrine that a literary concept is unique among concepts in that it can never be dissevered from its particular embodiment. This book updates and adds to the classic Social Movements of the Sixties and Seventies, showing how social movement theory has grown and changed.

With the publication of two books and a series of articles in the late 1960s and 1970s, E. D. Hirsch Jr. established himself as a major voice in the debates about interpretation and literary criticism. Against the mainstream, he proposed and defended an “objectivist” hermeneutics. His voice has remained alive in the debates as the proponent of objectivity in interpretation. As the title of his major book on hermeneutics, Validity in Interpretation (1976), suggests, Hirsch's primary concern is the (...) validation of an interpretation. According to Hirsch, validation is one of two sides of the interpretive process. The first step of any interpretation is guessing at its meaning. Hirsch's genial guess was Schleiermacher's divination. In the course of his discussion of genre, to clarify his view of interpretation, Hirsch mentions Emilio Betti's classification of three types of interpretation: re‐cognitive (historical and literary), presentational (dramatic and musical), and normative (legal and religious). Living labs are interdisciplinary and participatory initiatives aimed at bringing research closer to practice by involving stakeholders in all stages of research. Living labs align with the principles of participatory research methods as well as recent insights about how participatory ways of generating knowledge help to change practices in concrete settings with respect to specific problems. The participatory, open, and discussion‐oriented nature of living labs could be ideally suited to accompany ethical reflection and changes ensuing from reflection. To our knowledge, (...) living labs have not been explicitly trialed and reported in ethics literature. In this discussion paper, we report and discuss four initial issues that marked the process of setting up a living lab in ethics: (1) determining the goals and expected outcomes of an ethics living lab; (2) establishing operational procedures; (3) selecting communities and defining pilot projects; and (4) adopting a lens to tackle emerging questions and challenges. We explain these four issues and present the paths taken based on the novel and specific orientation, that is, living ethics, at the basis of this project. In alignment with living ethics and É‐LABO, we approach challenges as learning opportunities to ask not only “how” questions but also “why” questions. We hope that this discussion paper informed by our experience helps to clarify the theoretical, methodological, and practical approaches necessary to successfully adopt and employ living labs in ethics. Humans have long been characterized as poor probabilistic reasoners when presented with explicit numerical information. Bayesian word problems provide a well-known example of this, where even highly educated and cognitively skilled individuals fail to adhere to mathematical norms. It is widely agreed that natural frequencies can facilitate Bayesian reasoning relative to normalized formats (e.g. probabilities, percentages), both by clarifying logical set-subset relations and by simplifying numerical calculations. Nevertheless, between-study performance on “transparent” Bayesian problems varies widely, and generally remains rather unimpressive. (...) We suggest there has been an over-focus on this representational facilitator (i.e. transparent problem structures) at the expense of the specific logical and numerical processing requirements and the corresponding individual abilities and skills necessary for providing Bayesian-like output given specific verbal and numerical input. We further suggest that understanding this task-individual pair could benefit from considerations from the literature on mathematical cognition, which emphasizes text comprehension and problem solving, along with contributions of online executive working memory, metacognitive regulation, and relevant stored knowledge and skills. We conclude by offering avenues for future research aimed at identifying the stages in problem solving at which correct versus incorrect reasoners depart, and how individual difference might influence this time point. In this paper, I offer substantial philosophical and pragmatic analyses of slavery, apprenticeships, and segregation in the United States and British West Indies. I do so to illustrate the extent to which American and British philosophy, politics, law, and economics were entwined with the oppression of African-Americans and African-Caribbeans. I argue that, as the institution of slavery collapsed and abolitionists began calling for reparations, judges and politicians ignored the claims of abolitionists and thereby perverted justice. As a result, we now (...) have the debts of slavery, apprenticeships, and segregation to settle. I conclude that as long as we fail to settle these debts we are complicit in allowing their perversions of justice to continue. For this reason, I argue in favor of granting reparations to African-Americans and African-Caribbeans. (shrink)

In 1987, George Soros introduced his concepts of reflexivity and fallibility and has further developed and applied these concepts over subsequent decades. This paper attempts to build on Soros's framework, provide his concepts with a more precise definition, and put them in the context of recent thinking on complex adaptive systems. The paper proposes that systems can be classified along a ‘spectrum of complexity’ and that under specific conditions not only social systems but also natural and artificial systems can be (...) considered ‘complex reflexive.’ The epistemological challenges associated with scientifically understanding a phenomenon stem not from whether its domain is social, natural, or artificial, but where it falls along this spectrum. Reflexive systems present particular challenges; however, evolutionary model-dependent realism provides a bridge between Soros and Popper and a potential path forward for economics. (shrink)

DISCUSSIONS OF THE ONTOLOGICAL STATUS of Plato’s forms too often take for granted that immanence and transcendence are opposed to each other: if the forms are in instances then they are not separate from them, while if the forms are separate then they are not in instances. This assumption is sometimes associated with the theory that there is a change in Plato’s thought between the early or Socratic dialogues, in which forms are regarded as immanent, and the middle dialogues and (...) Timaeus, in which they are seen as separate. I will argue, however, that immanence and transcendence are not opposed but that, on the contrary, the former implies the latter. That is to say, precisely in that the forms are present in their instances, they are ipso facto also separate from them in all the senses which Plato claims. The idea of sensibles as images of the forms, in turn, is an expression not of transcendence alone, but rather of the conjunction of immanence and transcendence: the paradigm is at once transcendent to and immanent in the image. The movement from the early to the middle dialogues, then, is not the rejection of one position and the adoption of another, but simply the express articulation of what was implicit in the original position. Thus we find, not a fundamental change in Plato’s thought from one period to another, but a single consistent and coherent theory of forms which is developed throughout these dialogues. (shrink)

This article examines Harold Ramis’s 2005 noir comedy _The Ice Harvest_ as the critically dystopian counter-panel to his beloved 1993 film _Groundhog Day_, a film frequently discussed within the paradigm of utopia. While starkly different in genre, tone, and reception, the two films comprise a dialectical dyad that registers the historical transition from the utopian cultural effervescence of the early 1990s to the tragic foreclosure of imaginative horizons and the dystopian transformation of economic, political, and social landscapes in the new (...) millennium. In _The Ice Harvest_, the author argues, this is achieved through a strategic reactivation of film noir as a variant of the critical dystopia. (shrink)

Randomization is the “gold standard” design for clinical research trials and is accepted as the best way to reduce bias. Although some controversy remains over this matter, we believe equipoise is the fundamental ethical requirement for conducting a randomized clinical trial. Despite much attention to the ethics of randomization, the moral psychology of this study design has not been explored. This article analyzes the ethical tensions that arise from conducting these studies and examines the moral psychology of this design from (...) the perspectives of physician-investigators and patient-subjects. In this paper we compare the propositional logic of Frege’s Grundgesetze der Arithmetik to modern propositional systems, and show that Frege does not have a separable propositional logic, definable in terms of primitives of Grundgesetze, that corresponds to modern formulations of the logic of “not”, “and”, “or”, and “if…then…”. Along the way we prove a number of novel results about the system of propositional logic found in Grundgesetze, and the broader system obtained by including identity. In particular, we show that (...) the propositional connectives that are definable in terms of Frege’s horizontal, negation, and conditional are exactly the connectives that fuse with the horizontal, and we show that the logical operators that are definable in terms of the horizontal, negation, the conditional, and identity are exactly the operators that are invariant with respect to permutations on the domain that leave the truth-values fixed. We conclude with some general observations regarding how Frege understood his logic, and how this understanding differs from modern views. (shrink)

I would like to begin by discussing the legal and administrative framework of the role of the federal government in public health. At the heart of it is, of course, the Constitution. At the Department of Health and Human Services we depend, as does much of the federal government, on our power to regulate interstate commerce. Since the Supreme Court in 1942 removed essentially any restraint from the meaning of interstate commerce in Wickard v. Filburn, the federal government has been (...) regulating with wide latitude, in spite of small and, arguably, equivocal reverses in recent years. However, even though the Supreme Court no longer provides any real constitutional check on the federal government's interstate commerce power, some other restraints persist. For example, many parts of the health system have traditionally been deemed inherently state functions, such as the licensing and disciplining of doctors, nurses, and pharmacists, as well as the practice of medicine itself.
